1. Introduction
TheGardenPulse ("we," "our," or "us") is an independent fan community app built for Knicks fans and is not affiliated with, endorsed by, or sponsored by the New York Knicks, Madison Square Garden, or the NBA. This Privacy Policy explains how we collect, use, and protect your information when you use TheGardenPulse mobile application. By using our app, you agree to the practices described in this policy.
2. Information We Collect
2.1 Information You Provide
• Username and profile photo you create during onboarding
• Your Knicks fan story / biography
• Messages sent in community chats and direct messages
• Trivia answers and scores
• Garden Wall posts, captions, and comments
• Community names and settings if you create a private community
2.2 Information Collected Automatically
• Device type, operating system, and app version
• App usage data such as features accessed and time spent
• Push notification token (if you enable notifications)
• Crash reports and error logs for app improvement
2.3 Payment Information
If you subscribe to Garden Pass, all payment processing is handled entirely by Apple (App Store) or Google (Google Play). We do not collect, store, or have access to your payment card information.
3. How We Use Your Information
• To power app features including the leaderboard, Garden Noise Meter, Garden Wall, and community chats
• To calculate and display your Garden Record and leaderboard ranking
• To send push notifications about game events, trivia, and community activity (only if you opt in)
• To enforce our community guidelines and protect users from harassment and hate speech
• To improve the app experience based on usage patterns
• To process and maintain your Garden Pass subscription status
4. How We Share Your Information
We do not sell your personal data to third parties. We do not share your information with advertisers. Your data may be shared in the following limited circumstances:
• Service providers who help us operate the app (e.g., Firebase for database and authentication) — these providers are contractually bound to protect your data
• When required by law or to protect the safety of our users
• In the event of a merger or acquisition, with notice provided to users
5. Public vs. Private Information
Your username, profile photo, Garden Record, leaderboard rank, and Garden Wall posts are visible to other users of the app. Your direct messages are private between you and the recipient. Private community messages are visible only to members of that community.
6. Data Retention
We retain your account data for as long as your account is active. When you delete your account, all associated data including your Garden Record, leaderboard history, Garden Wall posts, and community messages will be permanently deleted within 30 days.
7. Push Notifications
You will be asked to opt in to push notifications after completing onboarding. We use notifications to alert you about game events, trivia availability, community activity, and Garden Breaker moments. You can disable notifications at any time through your device Settings app.
8. Children's Privacy
TheGardenPulse is intended for users who are 13 years of age or older. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it promptly.
9. Your Rights
You have the right to:
• Access the personal information we hold about you
• Request correction of inaccurate information
• Delete your account and all associated data via Settings > Delete Account
• Opt out of push notifications at any time
10. Security
We use industry-standard security measures including encrypted data transmission and Firebase security rules to protect your information. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of significant changes through the app. Continued use of TheGardenPulse after changes constitutes your acceptance of the updated policy.

1. Acceptance of Terms
By downloading, accessing, or using TheGardenPulse (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and TheGardenPulse ("we," "our," or "us").
2. Eligibility
You must be at least 13 years of age to use TheGardenPulse. By using the App, you represent and warrant that you are 13 years of age or older. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Account Registration
To access certain features, you must create an account with a username. You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring your username does not contain hate speech, slurs, or content that violates these Terms
We reserve the right to suspend or terminate accounts that violate these Terms at any time and without notice.
4. Community Rules
4.1 Prohibited Content
The following content is strictly prohibited on TheGardenPulse:
• Hate speech, racial slurs, homophobic language, or any language targeting individuals based on race, ethnicity, religion, gender, sexual orientation, or disability
• Harassment, bullying, or threatening behavior toward other users
• Spam, repetitive messaging, or unsolicited promotions
• Content that violates any applicable law or regulation
• Impersonation of other users, public figures, or TheGardenPulse staff
4.2 Enforcement
Violations of our community rules may result in:
• Temporary suspension of messaging privileges
• Permanent account ban without refund of any subscription fees
• Reporting to relevant authorities where required by law
5. User Content
You retain ownership of content you create and post on TheGardenPulse, including Garden Wall posts, community messages, and profile information. By posting content, you grant TheGardenPulse a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content within the App for the purpose of operating and improving the service.
You represent that you have the right to post any content you share and that such content does not infringe on any third-party intellectual property rights.
6. Garden Pass Subscription
6.1 Subscription Terms
Garden Pass is a recurring monthly subscription that unlocks premium features including unlimited messaging, daily trivia, full leaderboard access, Garden Wall posting, Garden Breaker eligibility, and private community creation.
6.2 Billing
Garden Pass is billed monthly through the Apple App Store (iOS) or Google Play Store (Android). Your subscription will automatically renew each month unless cancelled at least 24 hours before the end of the current billing period.
6.3 Cancellation
You may cancel your Garden Pass subscription at any time through your device's subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions). Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.
6.4 Free Tier
A free tier is available with limited features including up to 3 messages per day, leaderboard viewing, and Garden Wall browsing. Free tier features are subject to change.
7. Intellectual Property
TheGardenPulse and its original content, features, and functionality are owned by Dashpup Studios and are protected by applicable intellectual property laws. The App is not affiliated with, endorsed by, or associated with the New York Knicks, the NBA, Madison Square Garden, or any related organizations. All NBA team names, logos, and related marks are the property of their respective owners.
8. Trivia and Leaderboard
TheGardenPulse daily trivia is for entertainment and community engagement purposes. Leaderboard rankings are determined by our scoring formula (correct answers minus half of wrong answers) and are updated based on daily participation. We reserve the right to adjust scoring formulas, reset leaderboards, or modify trivia content at any time.
9. Garden Breaker and Badges
Garden Breaker badges are earned through community participation and engagement. They are digital achievements with no monetary value and are not transferable. We reserve the right to modify, remove, or adjust badge eligibility criteria at any time.
10. Disclaimer of Warranties
TheGardenPulse is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.
11. Limitation of Liability
To the fullest extent permitted by law, TheGardenPulse and Dashpup Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App. Your continued use of TheGardenPulse after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of law provisions.
